Accommodation Terms and Conditions
Article 1: Scope of Application
These Accommodation Terms and Conditions (hereinafter referred to as the "Terms") define the rights and obligations between our facility (hereinafter referred to as the "Facility") and the person entering into the accommodation agreement or related agreements (hereinafter referred to as the "Guest"). Matters not specified in these Terms shall be governed by applicable laws and general customs.
If the Facility agrees to special arrangements that do not contravene laws or customs, such arrangements shall prevail over these Terms.
Article 2: Application for Accommodation Contract
When applying for an accommodation contract or making a reservation, the Guest shall provide the Facility with the following information:
- Name and contact information of the Guest
- Dates of stay
- Accommodation plan
- Other information deemed necessary by the Facility
If the Guest requests to extend their stay beyond the initially stated dates in item (2) of this article, the Facility will treat such a request as a new application for an accommodation contract at the time of the request.
The accommodation plan (in the Article 3: Conclusion of Contract) specified at the time of application is valid only for that application. If the Guest wishes to stay under a different accommodation plan than originally applied for, a new application must be submitted. The initial reservation will not be automatically cancelled, and the Guest is responsible for taking any necessary steps for its cancellation.
In submitting the application for an accommodation contract, the Guest acknowledges and agrees that they shall not transfer the status or rights of the contract or reservation to a third party, except with the explicit prior consent of the Facility. This is to prevent unauthorized resale and to ensure fair access to accommodation for all guests.
Article 3: Conclusion of Contract
The accommodation contract shall be deemed concluded when the Facility accepts the Guest's application as described in the preceding article. However, depending on the accommodation plan, the contract shall only be considered concluded once advance payment has been made and the Facility confirms receipt of payment. If the Facility can demonstrate that it did not accept the application, the contract shall not be deemed concluded.
Article 4: Right to Refuse Contract
The Facility reserves the right to refuse an accommodation contract in the following circumstances:
- When the application does not comply with these Terms and Conditions
- When there are no available room
- When the Guest or user is recognized as falling under any of the following:
- When there is a risk that the Guest may violate laws or public order and morals
- When the Guest is identified as having a specified infectious disease
- When the Guest makes violent demands or requests that exceed reasonable limits
- When accommodation is not possible due to natural disasters or other unavoidable circumstances
- When the Guest is likely to violate the Facility's rules and regulations
- When prohibited by public health-related ordinances
- When bulk reservations are made in a manner that may hinder other guests' use of the Facility
Article 5: Guest’s Right to Cancel the contract
The Guest may cancel the accommodation contract by notifying the Facility if the cancellation is due to reasons attributable to the Facility.
Except for plans that explicitly prohibit changes or cancellations as specified in the cancellation policy, the Guest may voluntarily cancel the contract by notifying the Facility. In such cases, a cancellation fee will be charged in accordance with the Facility’s cancellation policy.
If the Guest fails to arrive within two hours after the scheduled check-in time on the first day of the stay without prior notice, the Facility may treat the reservation as voluntarily cancelled by the Guest.
Article 6: Facility’s Right to Cancel the contract
The Facility reserves the right to cancel the accommodation contract under any of the following circumstances:
- When it is recognized that the Guest may engage in, or has engaged in, conduct that violates laws, public order, or good morals in connection with the accommodation.
- When the Guest is identified as having a specific infectious disease.
- When the Facility is unable to accommodate the Guest due to natural disasters, facility malfunctions, or other unavoidable circumstances.
- When the Guest is deemed to fall under any of the following:
- When the Guest makes violent, threatening, coercive, or otherwise unreasonable demands upon the Facility or its staff, or makes demands exceeding reasonable bounds.
- When the Guest fails to comply with these Terms or with the Facility’s rules of use.
- When the Guest falls under circumstances specified in public health ordinances governing accommodations.
- When a minor attempts to stay without the consent of a guardian.
- When, for reasons other than those in item 3 above, the Facility is unable to provide the reserved room to the Guest (in such cases, the Facility will make reasonable efforts to arrange alternative accommodations).
- When the status or rights of the accommodation contract have been transferred to a third party without the Facility’s express consent.
- When a single party makes large-volume reservations that may interfere with the use of the Facility by other prospective guests.
Article 7: Registration
On the day of stay, the Guest must register the following:
- Name, age, gender, address, phone number, and occupation
- For non-resident foreigners: nationality, passport number, entry point, and date
- Departure date and time
- Other necessary information
If using non-cash payment, the method must be presented at registration.
Article 8: Room Usage Time
- The Guest may use the room from the check-in time until the check-out time as specified in the accommodation contract.Notwithstanding the preceding paragraph, the Facility may allow the Guest to use the room outside the designated hours. In such cases, an additional fee will be charged.
Article 9: Compliance with Rules
Guests shall comply with the Facility's rules as posted on the premises.
Article 10: Payment of Accommodation fees
The accommodation fee shall consist of the following: Room charges,Additional charges,Taxes,Service charges (where applicable).
Payment for the accommodation fee and related charges shall be made in cash, by credit card, or by any other method approved by the Facility. Payment must be made at the time of contract conclusion, during the stay, or upon request by the Facility.
Even if the Guest chooses not to stay after the Facility has prepared the room and made it available, the Facility reserves the right to charge the full accommodation fee.
Article 11: Storage of Guest’s Luggage or Belongings
If the Guest’s luggage arrives at the Facility prior to their stay, the Facility will store it with due care only if prior approval has been granted (including when using methods designated by the Facility), and will hand it over to the Guest upon check-in.
After check-out, the Facility will store the Guest’s luggage or personal belongings only if prior approval has been granted. If the luggage or belongings are not retrieved within the agreed-upon storage period, they will be considered intentionally abandoned and the ownership deemed waived.
If, after check-out, the Guest’s luggage or personal belongings are left behind without the Facility’s consent, and it is reasonably inferred that the items were intentionally left, or if no contact is made regarding the items after the Facility’s designated storage period, such items will be treated as having been intentionally abandoned and ownership will be considered waived.
Article 12: Handling of Valuables and Personal Belongings
As a general rule, guests are not permitted to bring large amounts of cash or valuables into the Facility.
The safekeeping and management of any cash, valuables, luggage, or personal belongings brought by the Guest shall be the responsibility of the Guest. The Facility shall only be liable for damage, loss, or theft if the Facility has expressly undertaken their safekeeping through a separate procedure, and only in cases where the Facility is found to have acted with intent or gross negligence.
Compensation under the preceding paragraph shall be limited to cases where the amount of damage can be objectively substantiated. In cases where objective valuation is difficult—regardless of the Guest's subjective valuation—the Facility's liability shall be limited to a maximum of 100,000 yen.
Article 13: Guest Responsibility
IIf the Facility incurs damage due to the intentional act or negligence of the Guest, the Facility shall be entitled to compensation for such damage from the Guest.
Article 14: Entry to Guest Rooms
Even after the Guest has checked in, the Facility may enter the guest room without prior permission from the Guest under the following circumstances:
- When providing services such as cleaning or room service.
- When it is deemed that the Guest may be engaging in, or has engaged in, acts that violate laws, the Facility’s rules, public order, or good morals.
- When entry is deemed necessary based on instructions from the police or fire department.
- When entry is deemed necessary for the maintenance and preservation of the building or its facilities.
- When the Facility deems it necessary to check on the Guest’s safety or well-being.
Article 15: Parking Responsibility
When a Guest uses the Facility’s parking area, the Facility merely provides a space for parking and assumes no responsibility for the management of the vehicle or the prevention of harm caused by third parties.
Article 16: Severability
Even if any provision of these Accommodation Terms and Conditions is deemed illegal or invalid by a public authority, the remaining provisions shall remain in full force and effect.
Article 17: Governing Law and Jurisdiction
These Terms shall be interpreted in accordance with the laws of Japan. All disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. However, if the Facility is located outside of Japan, these Terms shall be interpreted in accordance with the laws of the jurisdiction where the Facility is located, and no exclusive jurisdiction shall be designated.
Article 18: Revisions to the Accommodation Terms and Conditions
These Accommodation Terms and Conditions constitute standard terms under the Civil Code. If the revisions are deemed to be in the general interest of the Guests, or if there is a reasonable need for changes, the Facility may revise the Terms in accordance with the provisions of the Civil Code.
Any such revisions shall take effect from the effective date specified at the time the revised Terms are published on this website.
